Badr parliamentary: the presence of the Kurds within the government intended to privileges and gains
13/02/2016 11:33 | Direction Press Special /
MP for Bader’s parliamentary bloc mheibes Razak said the presence of Elsa Study Kurds within the federal government since 2003, but until now, its objective to obtain the privileges and gains of Kurdistan.
He mheibes in an interview for “direction” that the reason for the disruption of its oil and gas law are Kurds, noting that the oil and gas parliamentary, which is a member, whenever you try to initiate read this law provides Kurdish representatives in the Committee’s request and an appeal not to initiate it until get a political consensus on it , and on this basis the government to withdraw the law did not reach back to the House of Representatives until now.
He pointed out that the Commission on oil and energy parliamentary decided to write a new draft of the law, but the representatives of the Kurds filed the petition last not to initiate him for the same reason.
He pointed out that the Kurdish side varies with Baghdad on the interpretation of Article 112 and 111 of the Iraqi Constitution, noting that Article 111 indicated clearly that oil belongs to the Iraqi people,
while given Article 112 gave the breakdown of how the management of oil between the center and the Kurdistan and governorates not organized province, also gave Kurdistan and governorates not organized province the right to participate draw oil policies.
He added that politicians Kurds have resorted to tight international law interpreted them of Article 112 that have the right to manage oil wealth whether it’s in the extraction, development or production or export, so based on the word is not found in this article are intended,
pointing out that the paragraph He says Baghdad is given the right to manage oil wealth with regard to the current wells did not mention future wells, stressing that the Kurdistan took advantage of this loophole.
He added that Article 111 refutes this paragraph, where this article says that the oil and gas belongs to all the Iraqi people, it means that the central federal administration and the distribution by Baghdad to everyone, according to the proportion of the population is taken into account in that Mahromep ratio.
It is noteworthy that the oil and gas law of important laws, but he had previously introduced in the previous legislative session of Parliament, and did not get an agreement on the approval. http://aletejahtv.org/index.php/permalink/99424.html

that the Commission on oil and energy parliamentary decided to write a new draft of the law, but the representatives of the Kurds filed the petition last not to initiate him for the same reason
seems to be a misinterpretation of the Constitution, articles 111 and 112
Article 111 indicated clearly that oil belongs to the Iraqi people
Kurds have resorted to tight international law interpreted them of Article 112 that have the right to manage oil wealth whether it’s in the extraction, development or production or export, so based on the word is not found in this article are intended
pointing out that the paragraph He says Baghdad is given the right to manage oil wealth with regard to the current wells did not mention future wells, stressing that the Kurdistan took advantage of this loophole.
that Article 111 refutes this paragraph, where this article says that the oil and gas belongs to all the Iraqi people, it means that the central federal administration and the distribution by Baghdad to everyone, according to the proportion of the population is taken into account in that Mahromep ratio
FYI:
Article 111:
Oil and gas are owned by all the people of Iraq in all the regions and governorates.
Article 112:
First: The federal government, with the producing governorates and regional governments, shall undertake the management of oil and gas extracted from present fields, provided that it distributes its revenues in a fair manner in proportion to the population distribution in all parts of the country,
specifying an allotment for a specified period for the damaged regions which were unjustly deprived of them by the former regime, and the regions that were damaged afterwards in a way that ensures balanced development in different areas of the country, and this shall be regulated by a law.
Second: The federal government, with the producing regional and governorate governments, shall together formulate the necessary strategic policies to develop the oil and gas wealth in a way that achieves the highest benefit to the Iraqi people using the most advanced techniques of the market principles and encouraging investment.
I truly believe the only way to solve this contention between Baghdad and the Kurds is intervention from an international entity that has the respect of both parties. They are incapable of coming together on this because of years of mistrust .
